You Deserve an Experienced NYC Construction Accident Attorney:

The most dangerous jobs in New York City are those in construction. Even though New York has strict labor rules that require employers to make sure their workers are safe, accidents happen often. Across the city, dozens of building workers die on the job every year. Thousands more are hurt in painful and crippling ways.

Employers sometimes cut corners to save money, which is a shame. These shortcuts put you and other building workers in danger.

When you get hurt on a construction job, one of the most important things you can do is fight for payment. Don’t give your New York building accident case to just any lawyer. Even though you might be able to get money for your injuries, it can be hard to get the money. Insurance companies, the owners of the building site, and anyone else who did something wrong will fight you every step of the way.

Who’s Liable For My Injuries After a NYC Construction Accident?

You can’t walk through the city without seeing something being built. Because there are so many building sites and so many people who work in the industry, the state has passed a number of labor laws to make the job as safe as possible. Most of the time, these rules say who might be responsible for your injuries if you get hurt on a city construction site.

General Contractors and Construction Site Owners:

When a building owner in the city decides to build or change a building, they have to make sure that the workers have a safe place to work. Section 200 of the New York Labor Law says that owners and general contractors must “provide reasonable and adequate protection to the lives, health, and safety of all persons employed therein or lawfully frequenting such places.”

In other words, property owners and general contractors must take steps to make sure that building sites are safe. If there are any possible dangers that could hurt a person, they need to be fixed. Workers need to have the safety gear they need to do their jobs.

Site workers also need to be taught how to do their jobs in a safe way. It’s up to the general contractor and whoever owns the land being worked on to make sure it’s safe enough to work on.

People often call Section 240 of New York’s Labor Law the “Scaffolding Law.” It tells how scaffolding and other potentially dangerous building site equipment must be set up, secured, and fastened. It also gives workers who get hurt the right to hold property owners and/or general contractors strictly responsible if they get hurt by or on:

  • Scaffolding
  • Hoists
  • Stays
  • Ladders
  • Slings
  • Hangers
  • Blocks
  • Pulleys
  • Braces
  • Irons
  • Ropes, or other devices.

This area is for you if you built, torn down, fixed, changed, painted, or cleaned a building or structure.

With strict liability, you don’t have to show that the owner or worker did anything wrong.

Subcontractors:

There are a lot of moving parts on a building site. When a general builder wins a bid, they hire subcontractors to do some of the work. Subcontractors are just as responsible as general workers for making sure their work sites are safe. If a subcontractor is to blame for your injury, you might be able to hold them responsible.

Architects and Engineers:

If a worker gets hurt on a building site in New York, they may also be able to hold the site engineer or architect responsible. These people make plans for buildings and other things. When they do this, they must follow the standards of their trade. In New York City, architects and engineers have to make sure that places are checked regularly.

Were you hurt because a building fell down or something was wrong with its structure? Was it because of a bad plan or a lack of inspection? If so, the engineer or builder might be responsible for what happened to you.

Equipment Manufacturers:

There are a lot of different kinds of machinery and tools on construction sites. When these tools are broken, even the most skilled worker can get hurt. If you get hurt on the job because of a broken piece of equipment, you might be able to hold the company that made or sold it strictly responsible.

If I get hurt on a New York construction site, can I sue my boss?

It depends. After getting hurt on the job, any building worker can ask for workers’ compensation benefits. If you file for workers’ compensation, you usually give up your right to sue your company for personal injury. But you might still be able to sue someone else if you got hurt at work because of unsafe conditions or dangerous tools.

We’ll help you get money for all the injuries you got on the job.

Damages Are Available After a building accident in New York
Don’t think that an injury from a building accident won’t cost much. Medical costs can add up quickly. Even a small injury can keep you from going to work. If you lose your job suddenly, it can be hard to pay for your daily bills, let alone the costs of your injury.

When you get hurt on a New York construction site, you can seek:

  • Benefits from a workers’ compensation insurance policy, or
  • Compensation from a negligent third party (e.g., owner, contractor, architect).

Workers’ compensation will limit your recovery to money for medical bills, lost income, and disability.

When you file a lawsuit, you might also be able to receive money for:

  • Pain and suffering
  • Emotional distress, including anxiety and depression
  • PTSD
  • Rehabilitation
  • Nursing care
  • Disfigurement and scarring
  • Loss of consortium
  • Loss of enjoyment of life, and more.

Don’t take less than what your case is actually worth. We’ve worked hard to build ties with some of the most trusted accident experts in the tri-state area. They can give you important information about the more difficult and technical parts of your case.

We can learn more about your injuries and how they might change your life with their help. This can help us figure out how much your case is really worth.

How long do I have to file a claim after getting hurt?

How you want to get paid depends on what you want to do.

Workers’ compensation: If you get hurt on the job, you have 30 days to tell your boss about it. Then you’ll have a certain amount of time to send in your claim for benefits.

Personal damage Lawsuit: In New York, you have three years to file a claim for damage to your body before it’s too late.

If you wait too long to use your legal rights, you will lose the right to get the money you are owed.
